NHS Unsocial Hours Pay: What Agenda for Change Workers Are Entitled To
NHS workers on Agenda for Change (AfC) contracts have specific unsocial hours entitlements set out in the national terms and conditions. These aren't discretionary — they're contractual rights that apply to the majority of NHS staff. If you're an AfC employee and you're not getting the right payments, you're being underpaid.
What is Agenda for Change?
Agenda for Change is the pay and grading framework that covers the majority of NHS employees in England, Wales, Scotland, and Northern Ireland (with some regional variations). It covers everyone from Band 1 healthcare assistants to Band 9 senior managers — but not doctors, dentists, or very senior managers who have separate pay structures.
Which hours qualify as unsocial?
Under Agenda for Change (Annex 3), the following hours attract enhanced rates:

How unsocial hours pay is calculated
Unsocial hours payments are calculated on your basic pay only — not on any enhancements already included in your pay. The calculation:
Unsocial hours payment = (hourly basic rate × enhancement percentage) × qualifying hours worked
For example: if your hourly basic rate is £12.50 and you work 8 hours on a Saturday:
- Enhancement: 37% = £4.63 per hour
- Total Saturday premium: £37.00 for that shift
Part-time and bank staff
Part-time AfC staff receive unsocial hours payments pro-rata on the same basis as full-time staff. There's no minimum hours threshold.
Bank staff (NHS professionals, bank workers not on substantive contracts) may have different arrangements. Check your bank agreement carefully — some bank contracts include a consolidated rate that replaces separate unsocial hours payments.
How to check your payslip
On an AfC payslip, you should see:
- Basic pay (at your band and increment point)
- Unsocial hours supplement as a separate line, broken down by rate type
- Any on-call or standby payments
- Total gross pay before deductions
If unsocial hours payments appear as a single lump sum without breakdown, ask HR or payroll for an itemised statement showing the hours and rates applied.
Common errors to look for
- Incorrect hours counted: check your rota against the qualifying time periods
- Wrong base rate used: your rate should be your current band/increment rate, not an out-of-date figure
- Enhancement not applied to all qualifying hours: some payroll systems miss the midnight crossover on shifts
- Bank holiday not applied: any hours worked on a bank holiday should attract the higher rate, not just the regular Saturday or Sunday rate
If you think there's an error
- Gather your rota/timesheets for the period in question
- Calculate what you believe you should have been paid using the AfC tables
- Raise a formal query with payroll in writing (email is fine, keep a copy)
- If unresolved within a reasonable time, escalate to your line manager and HR
- Contact your union (Unison, RCN, RCM, BMA depending on your role)
Retrospective claims for underpayment under AfC are governed by the grievance procedure and can go back up to two years in some cases. Your union can advise on the specific process for your NHS trust.
